We call our users who submit articles or news to The USA Times, Journalists. The term is used to distinguish our bloggers from general users and it does not imply any employer-employee relationship with us. Term "Blogger" or "Journalist" can be used interchangeably on our website and will mean the same.

By joining The USA Times as a Journalist, you agree that:

  • Are of legal age to use this site, or have the parental/ guardian consent to do so ; (You may not use this site if you are under 13 years of age, and, you cannot purchase any deals if you are under 18 years of age.)
  • Shall not post articles or news that was already published on the Internet by you or someone else.
  • Shall protect you login and password used to access The USA Times and you agree that any unauthorized use of your account shall not be the responsibility of The USA Times.
  • Shall not use The USA Times to collect any personally identifiable information, including names, email addresses, account information or other such information, for any purpose;
  • Shall not use our forums, message board, email or other features for any commercial solicitation purposes;

  • Hereby grant a non-exclusive license to The USA Times, it's designated employees, user, any application authorized by The USA Times to access the content you submit through The USA Times and to use, edit, reproduce, distribute and display such content at its own discretion.

Your "The USA Times" Account

You can create your account with The USA Times by signing up on theusatimes.com, on our affiliate sites or through our Facebook App. When you join our Facebook App, your account on The USA Times is created automatically as we obtain your email address from Facebook by your permission. The security and privacy of your information including your email address and other information is regulated by our Privacy Policy which you can read by clicking here

The access to your account either created directly or through Facebook is your responsibility and in no way we are responsible for any misuse of your account by unauthorized access or through other means. Your password with The USA Times is always encrypted and not even our employees can know it. It's you responsibility to protect your password and not to disclose it to anyone including our employees, merchants or agents.

The USA Times reserves the right to terminate your account with us at any time with at its sole discretion with or without notification to you.

You herby agree that you shall not create an account on The USA Times if your account or site access has previously been terminated by The USA Times.

Non-Confidentiality and Privacy

You hereby agree that the information you shall provide to or on The USA Times through private emails, contact forms, message boards, chat rooms or on profile can be shared by The USA Times with its merchants and other affiliates and partners on as needed basis. The USA Times shall not treat any information given by you as confidential except your credit card information which is never stored on our servers and is transmitted to our processor through a secure connection (SSL), your password which is stored in encrypted format and your contact information including your address, phone number and email address which may be shared with our third party Email list management company.

We do our best to identify and remove any material that violates copyrights of others but it's possible that such content might be published by our users. In any such case, The USA Times will not be held responsible for any damages or loss that may have incurred by any party.

The USA Times's and User's entire liability and exclusive remedy in any cause of action based on contract, tort or otherwise in connection with any Services furnished pursuant to this Agreement including its Exhibits shall be limited to the total amount of money paid by the User to the The USA Times. No action, regardless of form, arising out of this document may be brought by either party more than one (1) year after the occurrence of the event giving rise to such cause of action.

EXCEPT WITH RESPECT TO AMOUNTS PAYABLE ARISING OUT OF CLAIMS BASED UPON SHALLFUL, MALICIOUS OR GROSSLY NEGLIGENT CONDUCT OF THE LIABLE PARTY, NEITHER THE SITE NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF THE SERVICES SHALL IN ANY EVENT WHATSOEVER BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, PUNITIVE OR INCIDENTAL DAMAGES IN EXCESS OF THE TOTAL PRICE PAID BY THE USER TO THE USA TIMES (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICES EVEN IF THE USA TIMES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALLTHE USA TIMES'S LIABILITY IN CONNECTION WITH THE USA TIMES SERVICES EXCEEDS THE AMOUNT PAID FOR SUCH SERVICES.

Limitations by Applicable Law.

CERTAIN JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF YOU RESIDE IN SUCH A JURISDICTION, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS. Electronic Communications

Most of the communication between you and The USA Times shall be through email, web posts or other electronic mediums. You hereby agree that all terms and conditions, agreements, notices, disclosures, and other communications that The USA Times delivers to you electronically satisfy any legal requirement that such communications would satisfy if it were in writing. The foregoing does not affect your non-waivable rights.

SEVERABILITY.

Should any provision hereof be deemed, for any reason whatsoever, to be invalid or inoperative, such provision shall be deemed severable and shall not affect the force and validity of other provisions of this Agreement.

GOVERNING LAW AND EXCLUSIVE JURISDICTION.

Any and all disputes arising out of these Terms and Conditions, its performance, breach, enforcement, existence or validity, including any failure of the parties to reach agreement with respect to matters provided for in these Terms and Conditions and all matters of dispute relating to the rights and obligations of the parties, which cannot be amicably resolved, even if only one of the parties declares that there is a difference, shall be referred to and finally settled by private and confidential binding arbitration before a single arbitrator held in Toronto, Ontario in English and governed by Ontario law pursuant to the Arbitration Act, 1991 (Ontario), as amended, replaced or re-enacted from time to time. The arbitrator shall be a person who is legally trained and who has experience in the information technology field in Canada and is independent of either party.

FORCE MAJEURE.

Both Parties shall not be held responsible for any delay or failure in performance under this Agreement rising out of causes beyond its control, or without its fault or negligence (Force Majeure). For the purposes of these Terms, "Force Majeure" means a strike, lockout, work stoppage or slow down or other labor dispute, popular uprising, sabotage, riot, rebellion, seizure, insurrection, act of terrorism, act of God, fire, storm, flood, war, accident, embargo, hostilities, explosion, perils of navigation, breakdown of or damage to any facilities, machinery or equipment (due to any cause or reason whatsoever) used to manufacture, obtain, store or distribute the Product, an act of any government, or any other event beyond the reasonable control of one party (whether similar or dissimilar to the causes specifically listed).

Advertising Packages

All advertising packages are sold on the website with guaranteed impressions or clicks or delivery to certain number of newsletter subscribers. The guaranteed clicks, impressions or email ads can be served within one year of the purchase of such plans and in case we are not able to deliver part of the agreed clicks, impressions or emails, we will be liable to refund only the amounts corresponding to the part of the clicks, impressions or emails we were not able to deliver within one year.

Refunds

When you buy a product from The USA Times, you shall be entitled for a full refund if requested within 5 days of the time when you purchased the product or committed to the purchase whichever is earlier. After that time, refund can only be issued at the discretion of The USA Times.

Account Cancellation

You can cancel the account with The USA Times anytime by logging in to your account and by clicking "Close My Account". Once your account is closed, you shall not be able to access your account again. All your information shall be deleted and your account details shall not be visible to you anymore. Your submitted articles will not be removed from the website even after you close your account. To remove any article you submitted on The USA Times, you are required to contact us explaining why you want the article to be removed.

Press Releases

The USA Times accept Press Releases from business and might charge business to publish and distribute their Press Release on the website and to several other sources. We have no way to ensure any specific number of hits, clicks or impressions any press release will get. We do not guarantee any number of minimum visitors to any Press Release page. All we guarantee is that the Press Release will be published on our site and will stay there for next 10 years. The URLs will be search engine friendly and will be accessible by the search engines.

Depending on the package you choose, we might send your press release to scores of different Press sources. We do not guarantee that those news sources will publish or pick your press release as they have their own criteria to determine what is newsworthy for them. You hereby agree that you will hold The USA Times responsible for lack of exposure or the news sources other than The USA Times own website.

ENTIRE AGREEMENT.

The provisions herein constitute the entire agreement between the parties and supersede all prior agreements, oral or written, and all other communications between the parties, including any and all supplier or distribution agreements. No term or condition contained in any document provided by one party to the other party pursuant to this document shall be deemed to amend, modify, or supersede or take precedence over the terms and conditions contained herein.

Disclaimers of Warranty

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. WE MAKE NO WARRANTIES AS TO PRIVACY AND SECURITY OTHER THAN AS EXPRESSLY STATED IN THE PRIVACY POLICY. WE DO NOT GUARANTEE THAT YOU SHALL BE ABLE TO ACCESS OR USE OUR WEBSITE AT ANY SPECIFIC TIME OR LOCATION. Termination

The USA Times reserve the right to terminate the whole website, a part of it at any time with or without prior notice to you. We may end this agreement at any time and in case of such termination you are responsible to cease the use of this website without further delay. If the termination is due to the violation of these terms our anti-spam policy, The USA Times shall not be liable honour any purchase, affiliate payment or any other payment.

Language of this Agreement

Both parties hereby express their wish to write this agreement and all the related agreements in English language and confirm that they fully understand every part of this agreement.
